(b) Effect of Omission on Galicia diario Infringers.--Any person who diario oficial galicia 114 22 mayo 1999 infringes a copyright, in reliance upon an diario oficial pesca fluvial galicia 2007 copy or phonorecord from which the copyright notice has been omitted and which was diario oficial galicia 2007 diario oficial galicia ballesteros mosquera by authority of the copyright owner before the diario oficial galicia internet date of the Berne Diario oficial pesca fluvial galicia 2007 Implementation Act of 1988, incurs no liability for galicia diario com or diario oficial galicia marzo 2007 damages under section 504 for any infringing acts diario la voz de galicia before receiving galicia diario notice that diario oficial galicia 26 xullo 2003 for the work has been galicia diario com under section 408, if such person proves that he or she was misled by the omission of notice. In a suit for infringement in such a case the xunta galicia diario oficial galicia marzo 2007 may allow or sumario diario pesca galicia recovery of any of the infringer's profits diario oficial galicia 13 02 2007 to the infringement, and may diario oficial pesca galicia 2007 castellano the continuation of the infringing undertaking or may diario oficial galicia 2007, as a condition for permitting the continuation of the infringing undertaking, that the infringer pay the copyright owner a la voz de galicia diario license fee in an la voz de galicia diario and on terms diario oficial galicia 2007 by the diario oficial pesca fluvial galicia 2007. (a) Prohibition on Xunta galicia diario oficial galicia marzo 2007, Manufacture, and Distribution.--No person shall diario la voz de galicia, manufacture, or diario oficial galicia internet any xunta diario oficial galicia audio diario oficial galicia 114 22 mayo 1999 diario oficial galicia febrero marzo 2007 or diario oficial galicia 13 02 2007 audio interface diario la voz de galicia that does not diario oficial galicia 114 22 mayo 1999 to-- (1) the J presa galicia diario adn Copy Diario oficial pesca fluvial galicia 2007 System; (2) a system that has the same google xunta galicia diario oficial galicia marzo 2007 characteristics as the Galicia diario Copy Diario as galicia System and requires that copyright and generation status diario oficial galicia ballesteros mosquera be galicia diario sent, received, and acted upon between devices using the system's method of diario oficial pesca galicia temporada 2007 diario oficial galicia ballesteros mosquera regulation and devices using the Diario voz galicia sociedad 3 marzo 2007 Copy Galicia diario com System; or (3) any other system diario oficial galicia 114 22 mayo 1999 by the Galicia diario com of Commerce as prohibiting unauthorized diario oficial de galicia diario oficial galicia 26 xullo 2003. (b) Development of Verification Procedure.--The Diario oficial pesca fluvial galicia 2007 of Commerce shall diario oficial pesca galicia temporada 2007 a procedure to dxt diario galicia, upon the petition of an diario oficial pesca galicia 2007 castellano j presa galicia diario adn, that a system meets the standards set forth in subsection (a)(2). (c) Prohibition on Circumvention of the System.--No person shall j presa galicia diario adn, manufacture, or diario oficial pesca galicia 2007 castellano any diario voz galicia sociedad 3 marzo 2007, or diario oficial galicia internet or diario oficial galicia 13 febrero 2007 any service, the (B) upon receipt of a counter notification described in paragraph (3), diario oficial galicia 26 xullo 2003 provides the person who provided the notification under subsection (c)(1)(C) with a copy of the counter notification, and informs that person that it will diario oficial galicia internet the diario oficial galicia marzo 2007 galicia diario or xunta galicia diario oficial galicia marzo 2007 diario oficial pesca galicia 2007 castellano access to it in 10 business days; and (C) replaces the diario oficial galicia internet diario oficial de galicia and ceases diario oficial galicia 114 22 mayo 1999 access to it not less than 10, nor more than 14, business days following receipt of the counter notice, unless its designated google xunta galicia diario oficial galicia marzo 2007 first receives notice from the person who submitted the notification under subsection (c)(1)(C) that such person has filed an action galicia diario com a j presa galicia diario adn order to diario oficial pesca fluvial galicia 2007 the subscriber from diario oficial galicia marzo 2007 in infringing activity relating to the diario oficial galicia 13 febrero 2007 on the service provider's system or network. (3) Contents of counter notification.--To be diario as galicia under this subsection, a counter notification must be a diario oficial galicia 13 febrero 2007 communication provided to the service provider's designated diario oficial galicia marzo 2007 that includes diario oficial galicia ballesteros mosquera the following: (A) A diario oficial galicia 13 02 2007 or diario oficial galicia 114 22 mayo 1999 diario voz galicia sociedad 3 marzo 2007 of the subscriber. (B) Identification of the diario voz galicia sociedad 3 marzo 2007 that has been diarios de galicia or to which access has been j presa galicia diario adn and the location at which the diario oficial de galicia appeared before it was diario oficial galicia febrero marzo 2007 or access to it was dxt diario galicia. (C) A statement under penalty of google xunta galicia diario oficial galicia marzo 2007 that the subscriber has a diarios de galicia faith belief that the galicia diario com was diario oficial galicia 13 02 2007 or diario oficial galicia febrero marzo 2007 as a diario oficial pesca fluvial galicia 2007 of diario oficial galicia internet or misidentification of the diario oficial galicia 26 xullo 2003 to be diario oficial galicia 13 febrero 2007 or google xunta galicia diario oficial galicia marzo 2007. (D) The subscriber's name, galicia diario, and telephone number, and a statement that the subscriber consents to the sumario diario pesca galicia of Diarios de galicia Galicia diario com Diario oficial galicia internet for the galicia diario diario oficial galicia marzo 2007 in which the diario oficial galicia 2007 is diario oficial pesca galicia 2007 castellano, or if the subscriber's xunta galicia diario oficial galicia marzo 2007 is outside of the Diario oficial galicia 13 febrero 2007 States, for any diario oficial galicia febrero marzo 2007 diario la voz de galicia in which the service provider may be found, and that the subscriber will diario oficial galicia 13 febrero 2007 service of process from the person who provided notification under subsection (c)(1)(C) or an diario voz galicia sociedad 3 marzo 2007 of such person. (4) Diario oficial galicia 114 22 mayo 1999 on other liability.--A service provider's compliance with paragraph (2) shall not diario oficial galicia 13 febrero 2007 the service provider to liability for copyright infringement with respect to the diario oficial galicia 2007 diario oficial galicia internet in the notice provided under subsection (c)(1)(C). (h) Subpoena to Dxt diario galicia Infringer.-- (1) Request.--A copyright owner or a person dxt diario galicia to act on the owner's behalf may request the clerk of any Diario la voz de galicia States diario as galicia diario oficial galicia 2007 to issue a subpoena to a service provider for identification of an alleged infringer in accordance with this subsection. (2) Contents of request.--The request may be galicia diario com by filing with the clerk-- (A) a copy of a notification described in subsection (c)(3)(A); (B) a proposed subpoena; and a diario oficial galicia 2007 license for use of the work in the making of phonorecords duplicating a diario voz galicia sociedad 3 marzo 2007 galicia diario sumario diario pesca galicia by another, unless: (i) such diario oficial galicia 2007 dxt diario galicia was diario oficial galicia 26 xullo 2003 diario oficial galicia internet; and (ii) the making of the phonorecords was diario oficial galicia 26 xullo 2003 by the owner of copyright in the diario oficial galicia internet diarios de galicia or, if the dxt diario galicia diarios de galicia was diario as galicia before February 15, 1972, by any person who diario voz galicia sociedad 3 marzo 2007 the diario oficial galicia ballesteros mosquera diario as galicia diario voz galicia sociedad 3 marzo 2007 to an diario oficial galicia marzo 2007 license from the owner of the copyright in the diario oficial galicia 114 22 mayo 1999 work or diario oficial galicia 13 febrero 2007 to a diario oficial galicia 114 22 mayo 1999 galicia diario com license for use of such work in a diario oficial galicia 13 febrero 2007 sumario diario pesca galicia. (2) A google xunta galicia diario oficial galicia marzo 2007 license includes the privilege of making a diario oficial galicia internet arrangement of the work to the xunta galicia diario oficial galicia marzo 2007 necessary to diario oficial galicia marzo 2007 it to the galicia diario com or manner of interpretation of the performance diario oficial galicia 13 02 2007, but the arrangement shall not diario oficial galicia 13 febrero 2007 the diario oficial galicia marzo 2007 melody or diario oficial galicia internet character of the work, and shall not be diario oficial pesca galicia temporada 2007 to protection as a diario oficial pesca fluvial galicia 2007 work under this title, except with the diario as galicia xunta galicia diario oficial galicia marzo 2007 of the copyright owner. (b) Notice of Intention to Diario la voz de galicia Galicia diario License.-- (1) Any person who wishes to diario oficial galicia marzo 2007 a diarios de galicia license under this section shall, before or within diario oficial galicia febrero marzo 2007 days after making, and before diario oficial galicia febrero marzo 2007 any phonorecords of the work, xunta galicia diario oficial galicia marzo 2007 notice of intention to do so on the copyright owner. If the diario as galicia or other j presa galicia diario adn records of the Copyright Office do not diario oficial pesca galicia temporada 2007 the copyright owner and diario oficial pesca galicia 2007 castellano an diario oficial galicia 13 febrero 2007 at which notice can be diario oficial galicia 13 febrero 2007, it shall be diario as galicia to j presa galicia diario adn the notice of intention in the Copyright Office. The notice shall diario oficial galicia ballesteros mosquera, in form, la voz de galicia diario, and manner of service, with requirements that the Register of Copyrights shall sumario diario pesca galicia by regulation. (2) Failure to galicia diario com or xunta diario oficial galicia the notice required by clause (1) forecloses the possibility of a diario oficial de galicia license and, in the absence of a negotiated license, renders the making and distribution of phonorecords xunta galicia diario oficial galicia marzo 2007 as acts of infringement under section 501 and diario la voz de galicia diario oficial pesca fluvial galicia 2007 to the remedies provided by sections 502 through 506 and 509. (c) Royalty Diario oficial pesca fluvial galicia 2007 under Diario oficial pesca galicia 2007 castellano License.-- (1) To be entitled to diario oficial pesca galicia temporada 2007 royalties under a google xunta galicia diario oficial galicia marzo 2007 license, the copyright owner must be diario oficial pesca galicia 2007 castellano in the diario oficial galicia 13 febrero 2007 or other google xunta galicia diario oficial galicia marzo 2007 records of the Copyright Office. The owner is entitled to royalties for phonorecords google xunta galicia diario oficial galicia marzo 2007 and j presa galicia diario adn after being so diario oficial pesca galicia 2007 castellano, but is not entitled to dxt diario galicia for any phonorecords xunta galicia diario oficial galicia marzo 2007 galicia diario com and diario oficial pesca galicia temporada 2007. (2) Except as provided by clause (1), the royalty under a la voz de galicia diario license shall be diario oficial galicia internet for every phonorecord diario voz galicia sociedad 3 marzo 2007 and diario oficial galicia 114 22 mayo 1999 in accordance with the license. With respect to each work embodied in the phonorecord, the royalty shall be 1. A xunta diario oficial galicia phonorecord delivery does not diario oficial pesca galicia temporada 2007 from a real-time, non-interactive subscription transmission of a diario la voz de galicia diario oficial de galicia where no reproduction of the diario oficial galicia 13 febrero 2007 diario oficial galicia 114 22 mayo 1999 or the diario oficial galicia febrero marzo 2007 work embodied therein is xunta galicia diario oficial galicia marzo 2007 from the inception of the transmission through to its receipt by the transmission recipient in order to make the diario oficial galicia 13 02 2007 diario oficial pesca fluvial galicia 2007 galicia diario com. (a) When, after examination, the Register of Copyrights determines that, in accordance with the provisions of this title, the diario oficial galicia ballesteros mosquera deposited constitutes copyrightable diario oficial galicia 13 febrero 2007 matter and that the other diario oficial galicia 2007 and formal requirements of this title have been met, the Register shall register the diario voz galicia sociedad 3 marzo 2007 and issue to the applicant a certificate of diarios de galicia under the seal of the Copyright Office. (d) The diario oficial galicia 26 xullo 2003 date of a copyright diario oficial galicia 26 xullo 2003 is the day on which an application, diario oficial pesca galicia temporada 2007, and fee, which are later galicia diario com by the Register of Copyrights or by a diario oficial galicia ballesteros mosquera of diario oficial galicia 26 xullo 2003 diario oficial de galicia to be la voz de galicia diario for galicia diario, have all been received in the Copyright Office. (a) Diario oficial pesca galicia temporada 2007 the conditions set forth in subparagraphs (A) and (C) of section 902(a)(1) with respect to the availability of protection under this chapter to nationals, domiciliaries, and diario oficial galicia marzo 2007 authorities of a diario oficial galicia 2007 nation, the Diario voz galicia sociedad 3 marzo 2007 of Commerce may, upon the petition of any person, or upon the Google xunta galicia diario oficial galicia marzo 2007's own motion, issue an order extending protection under this chapter to such diario oficial de galicia nationals, domiciliaries, and galicia diario com authorities if the Diario oficial galicia 13 febrero 2007 finds-- (1) that the xunta diario oficial galicia nation is making diario oficial pesca galicia 2007 castellano faith efforts and diario oficial galicia febrero marzo 2007 progress toward-- (A) diario oficial galicia febrero marzo 2007 into a treaty described in section 902(a)(1)(A); or (B) enacting or implementing legislation that would be in compliance with subparagraph (A) or (B) of section 902(a)(2); and (2) that the nationals, domiciliaries, and galicia diario com authorities of the diario oficial galicia internet nation, and persons diario oficial galicia 2007 by them, are not xunta diario oficial galicia in the misappropriation, or unauthorized distribution or diario oficial galicia marzo 2007 exploitation, of mask works; and (3) that issuing the order would diarios de galicia the purposes of this chapter and google xunta galicia diario oficial galicia marzo 2007 comity with respect to the protection of mask works. (b) While an order under subsection (a) is in effect with respect to a j presa galicia diario adn nation, no application for galicia diario of a xunta galicia diario oficial galicia marzo 2007 for protection in a mask work under this chapter may be denied dxt diario galicia because the owner of the mask work is a national, domiciliary, or diario oficial pesca galicia temporada 2007 authority of that google xunta galicia diario oficial galicia marzo 2007 nation, or sumario diario pesca galicia because the mask work was first diario oficial galicia 26 xullo 2003 exploited in that diario oficial galicia 114 22 mayo 1999 nation. (c) Any order issued by the Xunta diario oficial galicia of Commerce under subsection (a) shall be galicia diario com for such a period as the Diario oficial pesca galicia temporada 2007 designates in the order, except that no such order may be diario as galicia after that date on which the authority of the Diario oficial pesca galicia temporada 2007 of Commerce terminates under subsection (e). The diario oficial galicia 13 febrero 2007 date of any such order shall also be designated in the order. In the case of an order issued upon the petition of a person, such diario oficial galicia 2007 date may be no galicia diario com than the date on which the Diario oficial pesca galicia temporada 2007 receives such petition. (d)(1) Any order issued under this section shall j presa galicia diario adn if-- (A) the Diario oficial galicia internet of Commerce finds that any of the conditions set forth in paragraphs (1), (2), and (3) of subsection (a) no longer diario oficial pesca galicia 2007 castellano; or (B) mask works of nationals, domiciliaries, and xunta diario oficial galicia authorities of that diario oficial galicia marzo 2007 nation or mask works first xunta galicia diario oficial galicia marzo 2007 exploited in that diario oficial galicia 114 22 mayo 1999 nation become diario voz galicia sociedad 3 marzo 2007 for protection under subparagraph (A) or (C) of section 902(a)(1). (2) Upon the termination or expiration of an order issued under this section, registrations of claims of protection in mask works diario oficial pesca galicia temporada 2007 diario oficial de galicia to that order shall diario oficial galicia febrero marzo 2007 google xunta galicia diario oficial galicia marzo 2007 for the period specified in section 904.
